1. Introduction and Acceptance of Terms
These Terms & Conditions (“Terms”) govern the use of the DeepTrip Tours website and the booking, purchase, and participation in tours and travel experiences organized by DeepTrip Tours (“DeepTrip Tours,” “we,” “us,” or “our”).
By accessing our website, submitting a booking request, or purchasing a tour, you (“you,” “your,” or “Participant”) agree to the terms applicable to your booking.
Before completing a booking, you must have an opportunity to review these Terms, our Booking Conditions, and our Privacy Policy.
A person booking on behalf of other participants confirms that they have authority to make the booking and will communicate the applicable terms to those participants.
These Terms must be read together with the specific itinerary, price, inclusions, exclusions, and any additional conditions provided for the tour booked.
2. About DeepTrip Tours
DeepTrip Tours organizes guided group tours, private tours, customized itineraries, and adventure travel experiences in Canada and internationally.
Our destinations may include Banff, Yukon, Newfoundland, Québec, Vancouver Island, Mexico, Japan, Iceland, and other locations.
Depending on the tour, we may arrange accommodation, ground transportation, guides, excursions, attraction admissions, ferry transportation, outdoor activities, and other services included in the advertised itinerary.
The legal entity responsible for providing the services is [insert full registered legal name, including legal form, if applicable], operating under the trade name DeepTrip Tours.
3. Bookings and Contract Formation
Bookings may be initiated through our website, email, Instagram, WhatsApp, or another communication channel authorized by DeepTrip Tours.
A booking is considered confirmed once the required deposit has been received and DeepTrip Tours has acknowledged the booking in writing.
A booking inquiry, preliminary itinerary, or informal discussion does not by itself guarantee availability or confirm a reservation.
The itinerary, price, inclusions, exclusions, deposit amount, and payment deadline applicable to your tour will be communicated before or at the time of confirmation.
Where a booking is made online, the customer is responsible for reviewing the booking details and correcting any errors before completing the transaction.
We may decline a booking where availability cannot be confirmed, required information is missing, or participation requirements cannot be met. Any payments received for a booking we decline will be refunded, subject to any applicable legal requirements.
4. Tour Prices and Inclusions
The price of each tour is stated in the relevant tour description, quotation, or booking confirmation.
Unless expressly stated otherwise, the tour price includes the services and activities specifically identified as included in the published itinerary or written booking confirmation.
Depending on the tour, included services may comprise:
- Accommodation.
- Ground transportation during the organized itinerary.
- Guided activities and excursions.
- National park admission fees.
- Ferry transportation included in the itinerary.
- Admission tickets to museums, theatres, hot springs, nature reserves, and other attractions specifically included in the itinerary.
- Other activities, admissions, and services expressly promised in the confirmed tour program.
Meals are included only where specified in the relevant tour description or booking confirmation.
Unless expressly included in writing, the tour price excludes international and domestic flights, travel insurance, personal expenses, meals not listed as included, optional activities, personal equipment, and other services not identified as included.
A service expressly included in the confirmed itinerary will not become an optional extra merely because it is provided by a third-party supplier.
Any additional charges must be disclosed and agreed to where required by applicable law.
5. Deposits and Payment Terms
A deposit of between 20% and 40% of the total tour price is required to confirm a booking. The applicable percentage will be specified for each tour.
The deposit amount may vary depending on the tour, its itinerary, and the arrangements required to organize it.
The remaining balance must be paid no later than 30 calendar days before the tour’s scheduled start date.
After receiving the deposit, DeepTrip Tours will communicate with the customer to coordinate the booking and arrange payment of the remaining balance.
Payment methods may include Canadian bank transfers and payment links provided through Stripe or another payment method expressly approved by DeepTrip Tours.
Where offered, the remaining balance may be paid in two or three installments. All installments must be completed by the applicable final payment deadline.
A payment plan does not change the total tour price or extend the final payment deadline unless DeepTrip Tours expressly agrees otherwise in writing.
The customer is responsible for ensuring that payments are made on time and for any applicable bank or payment-provider fees disclosed before payment.
If the outstanding balance is not paid by the deadline, DeepTrip Tours may contact the customer to resolve the issue and may suspend or cancel the booking where permitted by the applicable Booking Conditions and law.
6. Cancellation by the Participant
A participant may cancel a booking by providing written notice to info@deeptriptours.com or through another written communication channel accepted by DeepTrip Tours.
Where cancellation is received at least 30 calendar days before the scheduled tour start date, the deposit will be refunded in full.
For cancellations received fewer than 30 calendar days before departure, payments are generally non-refundable, subject to any rights or remedies required by applicable law and any different written terms expressly agreed for the tour.
Because tour arrangements may involve advance commitments to accommodation providers, guides, transportation operators, and other suppliers, the availability of refunds may depend on the timing of cancellation and the applicable booking terms.
Participants should review the specific Booking Conditions before making a payment.
7. Changes to a Booking and Participant Substitution
A participant who cannot attend may request to transfer their booking to another eligible participant.
Transfers are subject to advance written notice, the replacement participant meeting the tour’s eligibility and safety requirements, and any necessary changes to reservations or supplier arrangements.
Any reasonable, disclosed costs associated with a permitted transfer may be charged where lawful.
The original participant remains responsible for any outstanding amounts unless DeepTrip Tours confirms a different arrangement in writing.
Changes to participant names or other booking details are not confirmed until acknowledged by DeepTrip Tours.
8. Cancellation by DeepTrip Tours
If DeepTrip Tours cancels a confirmed tour before departure, we will refund all amounts paid to DeepTrip Tours for that tour.
In addition, DeepTrip Tours will provide a credit for a future tour equal to the deposit paid for the cancelled booking. The credit will be subject to written redemption terms provided when it is issued.
The credit is separate from the refund and is not a substitute for the return of amounts paid.
This policy does not limit any additional rights or remedies that may apply under mandatory law.
Any credit expiry, transferability restrictions, or other redemption conditions will be communicated clearly and will not override mandatory consumer protections.
9. Itinerary Changes and Substitutions
Travel involves circumstances that may require adjustments to the published itinerary. These may include weather, road closures, wildfire activity, ferry or transportation disruptions, attraction closures, supplier availability, safety concerns, or other circumstances beyond our reasonable control.
Where a planned activity or service cannot reasonably be delivered, DeepTrip Tours will seek to arrange an alternative that is comparable in nature and, where reasonably practicable, in duration, quality, and planned organizational expenditure.
We will make reasonable efforts to preserve the overall character and value of the tour.
However, we cannot guarantee that every substitute will be identical to the original activity or that every planned stop will be available under all circumstances.
Safety, legal restrictions, operational feasibility, and supplier availability may require changes to the itinerary, including changes made during the tour.
Where a material change affects a confirmed booking, we will communicate the change and available options as reasonably practicable. Any refunds, credits, or other remedies will be determined by the applicable Booking Conditions and mandatory law.
10. Participant Responsibilities
Participants must:
- Provide accurate booking and contact information.
- Arrive at designated meeting points on time.
- Follow reasonable safety instructions provided by DeepTrip Tours and its guides.
- Respect local laws, cultural practices, wildlife, natural environments, and other participants.
- Maintain the physical fitness and equipment reasonably required for the advertised activities.
- Inform DeepTrip Tours in advance of relevant dietary needs, accessibility requirements, or other information necessary to organize the tour safely.
- Obtain and maintain valid travel documents, permits, and authorizations required for their journey.
- Avoid conduct that endangers themselves, other participants, guides, suppliers, or the public.
Participants are responsible for their personal belongings and for expenses arising from their own personal choices or conduct, unless otherwise required by law.
11. Minimum Age and Minors
The minimum age for participation is 12 years when accompanied by a responsible adult.
Participants must be at least 18 years old to participate without an accompanying adult.
The accompanying adult is responsible for the supervision of minors in their care, including compliance with reasonable safety instructions and applicable tour requirements.
Certain tours or activities may have additional age, supervision, fitness, or equipment requirements. These will be communicated in the relevant tour description.
DeepTrip Tours reserves the right to decline participation where applicable age or safety requirements are not met.
12. Adventure Activities and Assumption of Risk
Tours may include hiking, camping, wildlife observation, winter activities, hot springs, road travel, outdoor excursions, and other activities that involve inherent risks.
These risks may include uneven terrain, falls, changing weather, cold or heat exposure, wildlife encounters, remote locations, limited access to medical facilities, transportation incidents, and delays in emergency assistance.
Participants must assess whether the activities are suitable for their abilities and must follow the instructions of guides and activity providers.
DeepTrip Tours will take reasonable steps to organize activities with due regard for safety. However, we cannot eliminate every inherent risk associated with travel and outdoor activities.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
13. Medical, Fitness, and Accessibility Considerations
Participants are responsible for determining whether they are physically and otherwise able to undertake the activities included in their selected tour.
Participants should seek appropriate professional advice where they have concerns about their ability to participate safely.
Where relevant to the safe organization of a tour, participants should disclose necessary information about limitations, accessibility needs, or dietary requirements in sufficient time for reasonable arrangements to be considered.
DeepTrip Tours does not provide medical advice or medical treatment.
We will consider reasonable requests for accommodation in accordance with applicable law, the nature of the activity, and the practical and safety requirements of the tour.
14. Travel Documents, Entry Requirements, and Insurance
Participants are responsible for obtaining and carrying valid passports, visas, permits, and other documents required for their travel.
DeepTrip Tours may provide general information or guidance about travel-document requirements, but this does not replace official government advice or an individual’s responsibility to verify the requirements applicable to their nationality and circumstances.
Unless expressly included in writing, travel insurance is not part of the tour price.
Participants are strongly encouraged to obtain appropriate travel medical insurance, emergency evacuation coverage, and trip cancellation or interruption coverage suited to their itinerary and planned activities.
DeepTrip Tours is not responsible for a participant’s inability to travel due to missing or invalid documents, denied entry, or failure to satisfy applicable entry requirements, except where responsibility is imposed by law.
15. Conduct, Safety, and Removal from a Tour
Participants must treat other participants, guides, suppliers, local communities, and members of the public with respect.
Harassment, sexual harassment, discrimination, racism, threats, violence, unlawful drug use, and other serious misconduct are prohibited.
Participants must not deliberately disregard safety instructions, interfere with the safe operation of an activity, or engage in conduct that creates an unreasonable risk to themselves or others.
DeepTrip Tours may issue warnings, restrict participation in a particular activity, or remove a participant from a tour where reasonably necessary due to serious misconduct, safety concerns, or material violations of these Terms.
Where practicable, we will consider the circumstances and severity of the conduct before taking action. Immediate action may be necessary to protect safety.
Any decision concerning refunds or additional expenses following removal will depend on the circumstances, applicable Booking Conditions, and mandatory law. Nothing in this section authorizes an unlawful forfeiture of amounts paid.
16. Damage to Property
Participants may be held responsible for reasonable and documented repair or replacement costs for property they intentionally or negligently damage, where responsibility is established under applicable law.
This may include property belonging to accommodation providers, transportation operators, activity providers, other participants, or DeepTrip Tours.
Participants are not responsible under this section for ordinary wear and tear, pre-existing damage, or loss for which they are not legally responsible.
Any claim for compensation must be supported by reasonable evidence of the damage, the participant’s responsibility, and the amount claimed.
17. Third-Party Service Providers
DeepTrip Tours may arrange services supplied by independent hotels, guides, transportation operators, attraction operators, ferry companies, and other third parties.
We will take reasonable care in selecting and coordinating providers for the services included in our tours.
The fact that a service is supplied by a third party does not, by itself, exclude any responsibility that DeepTrip Tours has under applicable law for the tour package or its own acts and omissions.
Where a third-party provider has separate rules that apply to a service, participants must comply with those rules when they are communicated and lawfully applicable.
18. Photography, Video, and Media
Photography and video recording may take place during tours for operational, documentary, or promotional purposes.
Any use of an identifiable participant’s image, voice, or likeness for advertising, promotional materials, social media, or other public marketing purposes will be subject to a separate media consent or release where required by law.
Consent for promotional use should be distinct from acceptance of these Terms. Refusing promotional consent will not, by itself, prevent a person from booking a tour, except where a specific recording is genuinely necessary for a separately disclosed purpose and permitted by law.
Participants must respect the privacy of other participants and must not publish identifiable images or personal information in circumstances where doing so would violate applicable law or another person’s rights.
Further information about the collection, use, and retention of personal information is provided in our Privacy Policy.
19. Personal Information and Marketing Communications
DeepTrip Tours collects and uses personal information to respond to inquiries, process bookings, administer payments, coordinate travel arrangements, communicate with participants, and meet applicable legal obligations.
Personal information may be shared with service providers where reasonably necessary to deliver a booked tour, process a payment, or fulfil a lawful requirement.
Our handling of personal information is described in our Privacy Policy.
Marketing emails are sent in accordance with applicable consent requirements. A person may withdraw marketing consent or unsubscribe from promotional communications at any time.
Operational messages relating to an inquiry, payment, or confirmed booking may still be sent where reasonably necessary to provide the requested service or comply with legal obligations.
20. Website Use and Intellectual Property
Unless otherwise stated, the text, photographs, itineraries, branding, graphics, and other content published by DeepTrip Tours are owned by or used under licence by DeepTrip Tours.
You may not reproduce, distribute, commercially exploit, or modify our protected content without prior written permission, except where permitted by law.
You agree not to use our website for unlawful purposes, attempt unauthorized access to our systems, interfere with website operations, or submit information that is knowingly false or misleading.
Tour descriptions, photographs, and itineraries are intended to represent the travel experience accurately. Reasonable differences may occur due to seasonal conditions, supplier availability, or circumstances affecting delivery.
21. Complaints and Dispute Resolution
Participants should notify DeepTrip Tours promptly if they experience a problem during a tour, so that reasonable efforts can be made to address it while the tour is ongoing.
Written complaints may be sent to info@deeptriptours.com.
We will review complaints in good faith and seek to respond within a reasonable time.
Nothing in this section prevents a participant from exercising any statutory rights, filing a complaint with an appropriate regulatory authority, or pursuing a remedy available under applicable law.
22. Limitation of Liability
To the extent permitted by applicable law, DeepTrip Tours is not responsible for losses arising solely from circumstances outside our reasonable control, including natural disasters, severe weather, government restrictions, or independent transportation disruptions.
This provision does not exclude responsibility for our own negligence, breach of contract, misleading representations, or other liability that cannot lawfully be excluded or limited.
Nothing in these Terms limits any non-waivable consumer rights or remedies.
Any limitation of liability applicable to a particular tour must be interpreted consistently with the law governing the booking and the nature of the services supplied.
23. Force Majeure and Extraordinary Circumstances
An extraordinary event beyond the reasonable control of DeepTrip Tours may affect the delivery of a tour. Examples include natural disasters, wildfires, severe weather, public emergencies, government restrictions, and major transportation disruptions.
Where such an event occurs, we will make reasonable efforts to communicate with affected participants, assess available alternatives, and determine appropriate arrangements.
Possible measures may include itinerary changes, alternative activities, rescheduling, or cancellation.
The financial consequences of an affected booking will be determined by the applicable Booking Conditions and mandatory law. This section does not automatically eliminate refund rights or authorize DeepTrip Tours to retain payments where the law requires a refund.
24. Governing Law
These Terms are intended to be governed by the laws of the Province of Alberta and the applicable laws of Canada, subject to any mandatory consumer protection laws that apply to a particular participant or transaction.
Nothing in this section deprives a consumer of a right that cannot lawfully be waived or displaced by a contractual choice of law.
25. Changes to These Terms
DeepTrip Tours may update these Terms from time to time to reflect changes in our services, business practices, or applicable law.
The version applicable to a confirmed booking will be determined by the terms agreed at the time of booking, subject to any subsequent changes agreed by the parties or required by law.
Updated Terms will be published on our website with a revised effective date.
Changes to website terms will not automatically alter a confirmed booking where the participant has not agreed to the change and the law does not otherwise permit it.
26. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally permitted.
The remaining provisions will continue to apply to the extent that they can operate independently and consistently with applicable law.
27. Entire Agreement and Related Policies
These Terms, together with the applicable Booking Conditions, Privacy Policy, confirmed itinerary, booking confirmation, and any additional written conditions agreed for a particular tour, form the contractual framework applicable to the booking.
If documents conflict, the conflict will be resolved by considering the specific booking terms, the nature of the provision, and applicable law. No provision may override a mandatory legal right.
